General terms and conditions 'Roeland en Piet' catering in Amsterdam
Article 1. General
These terms and conditions apply to every offer, quotation and agreement between 'Roeland and Piet' and a client to which 'Roeland and Piet' has declared these terms and conditions applicable, insofar as the parties have not deviated from these terms and conditions explicitly and in writing.
In these terms and conditions, client is understood to mean any natural person or legal entity who instructs 'Roeland and Piet' to provide services and / or deliver goods.
The provisions of these general terms and conditions can only be deviated from in writing, in which case the other provisions of these general terms and conditions remain in full force. The agreed deviations only apply to the agreement in which the deviations have been agreed.
'Roeland en Piet' is authorized to make use of third parties in the performance of an agreement with the client. The present general terms and conditions also apply in that situation.
The latest Uniform Conditions for the Hotel and Catering Industry apply to all our agreements. These are the conditions on which catering companies established in the Netherlands provide their services and conclude agreements.
Article 2. Implementation and agreement
The execution of the agreement by 'Roeland en Piet' is based on the nature of the party, meeting, wedding, event or other catering activity indicated by the client, the circumstances and numbers stated. Client is obliged to provide all data and information required by 'Roeland and Piet', as well as all other data and information that may be important for the correct execution of the agreement by 'Roeland en Piet'. Client guarantees the correctness and completeness of all data and information provided to 'Roeland en Piet'.
If 'Roeland en Piet' is dependent on information to be provided by the client in the performance of an agreement, the client cannot hold 'Roeland en Piet' liable for failure to comply with the obligations, as long as the client does not provide all relevant information or did not provide the correct information.
In the event 'Roeland en Piet' delivers goods to the client without personnel, these goods are at the risk of the client from the moment of delivery.
If 'Roeland en Piet' delivers goods to the client, without personnel, the client has a 2-hour guarantee on the quality of the goods (food and / or drinks), from the moment of delivery, on the condition that the goods are stored and handled in accordance with the instructions from 'Roeland and Piet'.
If the client and / or guests of the client take goods (food and / or drinks) from 'Roeland en Piet' from the location, this is at the expense and risk of the client and / or his guests.
The quotation mentioned is based on the specified number of people, the location and the specified time schedule. Changes in this may affect the quotation we have submitted.
All glassware, crockery, linen, warming boxes / trays, serving dishes, serving dishes and other non-consumptive goods made available by 'Roeland and Piet' remain the property of 'Roeland en Piet'.
If goods from 'Roeland and Piet' are left behind at the location, the client is obliged to return these goods to 'Roeland and Piet'. Damage to or loss of these non-consumptive goods caused by the client and / or its guests will be passed on to the client by 'Roeland and Piet' at cost price.
In addition, we are forced to pass on all costs for rental items.
Article 3. Prices
If 'Roeland en Piet' and the client have agreed that 'Roeland en Piet' concludes an agreement with a third party on behalf of his client and this third party increases its prices, then 'Roeland en Piet' is entitled to charge the new applicable prices to his client.
Price increases resulting from changes and / or additions to the assignment by the client are at the expense of the client.
A price increase does not entitle the client to dissolve the agreement.
Payment of any additional costs must be made at the same time as payment of (the last installment of) the principal sum.
Client is entitled to make changes to the agreed numbers of persons and / or goods to be delivered or services to be performed or dietary requirements up to 7 days before the execution of the agreement by 'Roeland en Piet', on the understanding that the changes may be a maximum of 10% (more or less) of the numbers of persons and / or goods to be delivered or services to be performed already agreed.
All changes that are communicated after 7 days prior to the planned catering date will, in connection with purchasing and personnel planning, be fully passed on to the client.
Price increases resulting from changes and / or additions to the order by the client are at the expense of the client.
Article 4. Cancellation
The client is not authorized to cancel an agreement, unless at the same time it irrevocably offers to pay the amounts determined below. In case of cancellation of the confirmed offer, cancellation costs will be charged based on the period up to the reservation date:
In case of cancellation more than 1 months before the time of execution of the agreement, the client is not obliged to pay any compensation to 'Roeland en Piet'.
In case of cancellation more than 14 days before the said time, the client is obliged to pay 25% of the total sum to 'Roeland en Piet'.
In case of cancellation more than 7 days before the said time, the client is obliged to pay 50% of the total sum to 'Roeland en Piet'.
In case of cancellation 7 days or less before the said time, the client is obliged to pay 100% of the total sum to 'Roeland en Piet'.
Cancellation must be made in writing. The calculation of the amount to be paid is based on the day on which the written cancellation reaches 'Roeland en Piet'. The client cannot derive any rights from a verbal cancellation.
Article 5. Payment
After the order confirmation, 50% must be paid in advance by the client to 'Roeland en Piet'.
The advance invoice must be paid no later than 1 week before the event. If this is not the case, we cannot proceed with the implementation of the catering. For assignments greater than € 1,000, the advance shot must be paid no later than 2 weeks before the event.
The remaining 50% of the invoice must be paid no later than 1 week after the date of the delivered goods.
If and insofar as timely payment is not made of the outstanding 50% of the invoice to be paid afterwards, a maximum extension period of 14 days applies to still pay. If the customer is in default, he must reimburse 'Roeland and Piet' for all costs related to the collection. The extrajudicial collection costs are charged according to the law.
Article 6. Advertising
The client is obliged to inspect the delivered goods or have them examined immediately at the moment that the goods are made available to the client or the relevant services have been performed. In addition, the client should investigate whether the quality and / or quantity of the delivered goods correspond with what has been agreed and meet the requirements that the parties have agreed in this respect. In case of complaints about the quality of food and / or drinks, the client must report this to 'Roeland and Piet' within 2 hours after delivery, so that 'Roeland and Piet' has the opportunity to check the validity of the complaint and, if possible, remedy this. . If the client has not handled the delivered goods in accordance with the instructions of 'Roeland en Piet' regarding storage and handling, the possibility to complain will lapse.
Article 7. Dissolution
If the client does not or not timely fulfill his obligations arising from the agreement, and this non-fulfillment justifies termination, then 'Roeland en Piet' is entitled to terminate the agreement immediately and with immediate effect without any obligation on its part to pay any compensation or compensation. , while the client, on account of breach of contract, is obliged to pay compensation or compensation.
